Sexual harassment refers to various sexual behaviours which can be divided into 5 types:

  1. Verbal harassment
  2. Harassment in the form of signs/non-verbal
  3. Visual harassment
  4. Psychological harassment
  5. Physical harassment

 

This department is responsible for handling complaints of sexual harassment in the workplace. Complaints can be made by phone, going personally to the nearest Labour Office or sending a letter to the Labour Office. The complainant must provide the following basic information:

  • Name and address of the party complained against
  • The complaint issues must be set in detail
  • Name and address of the complainant

 

The department has implemented a Prevention and Eradication of Sexual Harassment in the Workplace Programme to promote the establishment of an internal mechanism to deal with sexual harassment in the workplace. The objectives of this programme are:

  1. To create awareness among the public of the role of the department in handling the Code of Practice on Prevention and Eradication of Sexual Harassment in the Workplace
  2. To encourage employers to establish an internal mechanism on prevention and eradication of sexual harassment in the workplace
  3. To expose the public, especially workers, to the role and action that can be taken in the event they or someone close to them experiences sexual harassment.

Effective from 1 April 2012, the Amended Employment Act 1955 has included a new section on sexual harassment, i.e. Part XVA, Sections 81A to 81G.

 


Complaints can be made by:

  • Telephone; or;
  • Going personally to the nearest Labour Office; or
  • Sending a letter to the Department of Labour

The complainant must provide the following basic information :

  1. Name and address of the party complained against
  2. The complaint issues must be set in detail
  3. Name and address of the complainant

 

Sexual Harassment Complaint Procedure:

  1. Receive complaint from the complainant/victim
  2. Interview the complainant / victim
  3. Conduct investigation to determine the validity of the case
  4. Case closed / completed
  5. Interview the employer and request for investigation at the company level
  6. Receive investigation report from the employer
  7. Review the investigation report
  8. Interview the harasser
  9. Officer prepares a report and recommendations
  10. Recommendations are sent to the employer
  11. Inform the victim of the investigation results
  12. The victim is satisfied or dissatisfied
  13. Close
  14. Investigating officer advises the victim to refer the case to the police / other agencies
  15. Case closed
